[0:00]pure and beloved messenger the peak of his creation the symbol of
[0:07]humanity the holy prophet Muhammed and his Immaculate progeny of the bit
[0:20]peace be upon them especially the leader of our time the awaited
[0:24]Savior IM Al may Allah Hast in his reappearance and make us
[0:32]all amongst his sincere and dedicated servants respected brothers and sisters Allah
[0:45]subhah Waal states in the Holy Quran in verse 60 illuminates your
[1:24]hearts and Minds with a salawat Allah subhanahu wa ta'ala created us
[1:37]and therefore he is our owner given that Allah is our owner
[1:43]it follows that he reserves the exclusive and sole right to legislate
[1:51]laws for us if I am the creation of God who is
[1:57]my Creator and my Lord he has the authority to who legislate
[2:00]laws for me he's my owner and when you own something you
[2:07]have the greatest right to it that is why our trial in
[2:14]this life is to abide by the laws of God not because
[2:17]they are only beneficial to us sure the laws of God are
[2:23]aimed at organizing our lives elevating our spirituality exploring our intellectual dimensions
[2:29]and preparing us for the day of judgment we get all these
[2:33]benefits by following God's laws but we also primarily follow the laws
[2:38]of God because he's our owner and he has the ultimate authority
[2:47]over us now this presents a very important dilemma for us these
[2:50]days the Holy Quran is very clear that if we go by
[2:56]any law other than the law of Allah subhanahu wa ta'ala then
[3:02]we are deviants I will share with you four verses from the
[3:07]Holy Quran one verse in fact it's a set of verses inah
[3:13]verse 44 45 and 47 Allah subhah wa taala repeats this statement
[3:20]three times because it's so significant inah verse 44 Allah subhana wa
[3:30]ta'ala States we have revealed the Torah it contains light and guidance
[3:41]the Torah is one of the scriptures that Allah sent to humanity
[3:45]it's full of wisdom it's full of divine laws the original tah
[3:53]that Allah sent and Allah gave the Torah as a constitution for
[3:56]the prophets to judge according to it to rule according to the
[4:01]tah now what does Allah subhana tala State at the end of
[4:07]the verse those who do not rule by what Allah subhah wa
[4:18]ta'ala has revealed those who do not judge according to God's law
[4:23]what does the Quran label them what are they Allah says they
[4:31]are disbelievers they have no faith if you go by any law
[4:33]other than my law then you have no faith that's verse 44
[4:38]and then in verse 45 Allah subh T talks about the law
[4:44]of Retribution and then at the end Allah makes the same statement
[4:50]what are they now these people are the oppressors the unjust ones
[4:59]and then we have verse 47 after Allah speaks about the T
[5:07]Allah addresses the inil the [Music] bible let the people of the
[5:19]injil the Bible rule according to what God has revealed in the
[5:22]Bible what if you don't do that and those who do not
[5:30]rule according to what Allah subhah wa tala has revealed what are
[5:35]they this time they have deviated from the right path so one
[5:42]verse says they are oppressors one verse says they have no faith
[5:46]one f verse says they have strayed these three verses tell us
[5:53]that we have to rule by the law of God now let's
[5:55]come to a very important verse the fourth verse verse vers 60
[6:01]Allah subhana T states don't you look at those who claim they
[6:11]have faith they claim they believe in what has been revealed to
[6:17]you the Holy Quran they also claim to believe in previous scriptures
[6:25]they act like they believe but then what's their problem you read
[6:33]when it comes to their disputes to their judgments to their Law
[6:38]and Order they go to the they submit their cases for judgment
[6:44]to the what does mean basically means Injustice those rulers who rule
[6:56]unjustly they are referred to as the in the Holy Quran they
[7:03]don't rule by the law of God they impose their own unjust
[7:07]laws so the Holy Quran is criticizing them but Allah has commanded
[7:19]them to reject the to reject anything that's not godly any law
[7:22]that does not come from Allah you have to reject it we
[7:26]have these four very important verses in the the Holy Quran and
[7:33]then when you come to the of you find there's a very
[7:40]significant and critical Hadith from IM in explaining this verse this Hadith
[7:46]is narrated by one of the companions of IM by the name
[7:51]of and this Hadith is accepted by scholars in fact they label
[7:58]this Hadith as the accepted report of what does the report say
[8:08]goes to and he tells him there is a dispute amongst two
[8:12]of our men two of the followers of they have an argument
[8:18]they have a fight over money that they borrowed from one another
[8:23]an amount of loan M they're fighting over inheritance we have a
[8:28]financial dispute is it okay for them to go to the ruler
[8:35]of the country or the judge of the town is it okay
[8:39]for them now at the time during the time the end of
[8:42]the era of bani and B and the beginning era of B
[8:47]Abbas the judges would not rule by the just law of God
[8:50]there was a lot of Injustice and corruption in their legal rulings
[8:56]so this companion is asking Al Imad is it okay for me
[8:59]to go to the court at the time what is the response
[9:04]of IM it's a very bone chilling response the Imam States no
[9:09]they are not justified in going to the you want them to
[9:15]go to the T to these oppressive figures who do not implement
[9:18]the law of God and then the Imam makes a very powerful
[9:24]statement here he says even if you're going to court to get
[9:27]your H your right because you're supporting this system you are condemned
[9:32]so he tells the IM then what do I do in that
[9:35]case the Imam tells him go to Scholars who know our law
[9:41]who know the law of God and get the ruling from them
[9:46]and apply the law of Allah subh tala so now we have
[9:48]four verses of the Holy Quran and we have hadiths along these
[9:53]lines this now presents a huge dilemma for us who live either
[9:57]in non-muslim countries or you could be living in a Muslim country
[10:00]that does not implement the law of God cuz you think all
[10:05]these 50 Muslim countries on the you know map today they apply
[10:08]the law of God believe me in some of these countries you
[10:13]find very little laws that have anything to do with Allah subh
[10:16]so this creates a dilemma for us especially here in this country
[10:21]and now Scholars are discussing this many people are asking can I
[10:26]go to the legal system here can I go to court can
[10:27]I seek a lawyer in fact can I be a lawyer we
[10:31]know that in the United States Americans are very litigious you've got
[10:37]a lot of litigation going on here in this country every single
[10:42]year we have about a 100 million cases in state trial courts
[10:51]how many cases 100 million now the population is like 350 million
[10:56]so can you imagine the sheer size of all these cases and
[11:01]in the federal trial courts you have about 400,000 cases every year
[11:05]so we're talking at over a 100 million cases and here in
[11:12]America you cannot live throughout your life without going to court without
[11:17]getting a ruling from a judge without seeking the services of a
[11:21]lawyer right they're indispensable just in Michigan we have about 46,000 attorneys
[11:28]we need them for so many things in our lives you know
[11:34]they say lawyers are like a nuclear bomb nuclear weapon once one
[11:38]side gets one the other side has to get one too and
[11:44]once you launch them there's no way to reclaim them back and
[11:47]stop them and once they land they cause destruction to both parties
[11:51]we live in a society that is based on litigation right and
[11:58]the law lets you sue for anything Americans are known to sue
[12:02]for literally anything a car accident something goes wrong you sue your
[12:07]neighbor sneezes in your face you can go take them to court
[12:12]and sue you spill hot coffee on your hands and it burns
[12:14]you you go and Sue McDonald's anything that happens Yu we got
[12:18]a divorce case you got to go and find the lawyer and
[12:22]go to court you know there is an inheritance will that you
[12:25]need to implement it you need to go to the court system
[12:28]you cannot live without the system and so now the genuine pressing
[12:34]question is I as a Muslim who wants to abide by the
[12:35]law of Allah subhana wa tala what do I do because some
[12:39]people will come and tell you look the Quran is telling you
[12:42]if you don't rule by the law of God you're a f
[12:47]you're a you're a CF you're resorting to the system of so
[12:52]it's very important for us Muslims to have this conversation at the
[12:55]end of the day I want to please Allah subhah wa ta'ala
[12:59]I want to live a life life that is in The Obedience
[13:05]of Allah subhana wa ta'ala a life that respects the instructions of
[13:08]the Holy Quran and the teachings of so how do we navigate
[13:13]this my dear brothers and sisters I will share with you the
[13:16]following Dimensions one is about lawyers and the second one is about
[13:21]you who seek the services of a lawyer so are lawyers Halal
[13:28]or not yes I'm coining that term no don't try to eat
[13:31]a lawyer please saying the say is saying if they're Halal or
[13:36]not but is it legitimate to be a lawyer in any country
[13:40]or society that does not go by the law of Allah subhana
[13:44]wa tala is that legitimate or not you as a lawyer when
[13:47]you're taking cases are you allowed to advocate for cases that do
[13:54]not follow the guidelines of the Quran that do not follow the
[13:57]guidelines of the religion of Islam this is a very important question
[13:59]that we need to answer we need to have a scholarly discussion
[14:02]on this so let's break this down you as a lawyer there
[14:10]are three types of cases clients that can come to you and
[14:13]each one can have a different ruling the first scenario is that
[14:22]you as a Muslim lawyer you have non-muslim clients so the client
[14:27]who comes up to you and asks you to work work on
[14:31]their case is a non-muslim client what did Islam teach us about
[14:36]dealing with non-muslims we have many many narrations from the that point
[14:45]us to an Islamic principle called if I want to translate that
[14:54]for you I would call it the Interfaith law or the universal
[14:58]global Humane law but let's just stick to the first one the
[15:02]Interfaith law in oneith the IM States when it comes to non-muslims
[15:17]they have their own laws their own beliefs I as a Muslim
[15:19]I respect that I recognize that you have your own way of
[15:24]getting married you have your own way of getting divorced you have
[15:26]your own way of dividing The Inheritance you have your own way
[15:30]of selling and buying and doing all these transactions every group of
[15:34]people every nation have their own laws so the IM told his
[15:41]followers if they believe in a certain law that's fine you can
[15:46]hold them to that law in another Hadith the IM states it
[15:57]is possible for every group of people whatever they find lawful so
[16:04]let's say in our Islamic law right incest is Haram right a
[16:11]brother cannot marry his sister but you know there were groups of
[16:15]people like the majus the zoroastrians in their legal religion this was
[16:20]lawful now Islam Advocates against incest and it banded on Muslims it's
[16:28]a big sin for a brother to marry his sister this is
[16:30]not recognized in the law of Allah subhana wa tala but there's
[16:34]a group of people a religion who believe in that okay Islam
[16:36]is not going to fight them and stop them and tell them
[16:40]this is not allowed fine if in your Society that's how you
[16:43]get married we disagree we don't consider that as a valid marriage
[16:46]but that's fine if that's how you get married go get married
[16:50]that's fine I'm not going to prevent you and you can be
[16:53]husband and wife that's fine the same with marriage laws divorce laws
[16:56]in Islam we have certain require requirements for you to get divorced
[17:02]for instance in the school of you need to have two just
[17:04]Witnesses when the statement is said now the sunnis don't have that
[17:09]you don't need to say it in the presence of two witnesses
[17:11]okay that's fine if a Sunni divorces his wife according to his
[17:15]law I respect that I can consider them to be divorced I
[17:20]as a Shia I cannot go to them and tell them no
[17:24]no you're not divorced you didn't divorce her because you didn't do
[17:27]it according to my law the imams told us respect the laws
[17:31]of people we can go by their laws when we're treating them
[17:34]and dealing with them the same applies to non-muslims today if a
[17:39]non-muslim couple goes to the court system here and they get their
[17:45]marriage registered there they don't go to church they don't go to
[17:46]a synagogue they don't go anywhere do I treat them as husband
[17:52]and wife I as a Muslim do I consider them as a
[17:53]husband and wife sure if Society considers that as marriage by going
[17:59]to the court and filing for a marriage certificate you can treat
[18:03]them as a husband and wife that's fine so when it comes
[18:09]to you as a lawyer and you have non-muslim clients you can
[18:13]apply the law of the land on them whatever they believe in
[18:16]to be the law you can apply it on them we don't
[18:22]have an issue there yes you have to maintain Justice if you
[18:25]know that one of your clients is really guilty and he is
[18:29]paying you more in order to flip the truth that's Haram at
[18:33]the end of the day you as a law lawyer you have
[18:38]to be honest you have to defend the truth now sometimes some
[18:42]lawyers ask me this question say a person comes and he tells
[18:44]me I'm guilty but hey get me out reduce the sentence can
[18:49]I take a case like that if your client is being subjected
[18:55]to an unfair sentence yes you can help them get a fair
[19:01]sentence and sometimes it happens look we don't have a perfect court
[19:04]system here in the US right sometimes if you have connections the
[19:08]other side can get a better lawyer there are many ways to
[19:13]twist the truth it's not a perfect system therefore you as a
[19:19]lawyer if you know that your client is guilty but the sentence
[19:22]that's going to be passed on them is not a fair sentence
[19:28]you can take on their case and advocate at for a fair
[19:29]sentence that's fine so as long as you're implementing Justice you're protecting
[19:36]the rights of citizens it is okay for you to be a
[19:39]lawyer and advocate for them this is the first category which is
[19:46]pretty straightforward and our Scholars accept that let's now come to the
[19:51]second category which is really the tough one you have two clients
[19:56]who come to you and they're Muslim and when you look at
[20:01]the law of the land you find that it does it's not
[20:03]compatible with the law of the Quran it's not compatible with the
[20:09]law of Islam you as a Muslim lawyer are you allowed to
[20:14]take up their cases and advocate for a sentence for a settlement
[20:20]for an order for a ruling that's not compatible with the Quran
[20:26]I know this is a very sensitive discussion here brothers and sisters
[20:32]but we have these verses in the Quran and thei of and
[20:34]the fwa of our Scholars it's very clear you cannot take Muslim
[20:42]clients as a lawyer and advocate for Allah for an outcome that
[20:47]is not compatible with the Holy Quran this would be a violation
[20:52]of the Holy Quran a violation of the Hadith and that is
[20:56]resorting to the that's a very sensitive point I know it's a
[21:00]very sensitive point but we have to know our law at the
[21:03]end of the day you're free you can do whatever you want
[21:05]as long as what you're doing is legal you can do whatever
[21:08]you want in this country but I as a Muslim I need
[21:12]to know what my limits are for instance this happens in the
[21:15]community a family comes to you they're Muslims the husband died and
[21:21]he did not leave a legal will behind you know what happens
[21:27]most of the times in some families the wife takes all the
[21:32]inheritance say it I stood with him for 30 years I sacrificed
[21:37]why are my children getting it my sons were busy with their
[21:40]own business I respect the fact that you stood there in this
[21:43]beautiful marriage for 30 years may Allah bless you may Allah infinitely
[21:48]reward you but that inheritance is not yours the wife gets 1/8
[21:55]of The Inheritance according to the law of the Quran so if
[21:58]the wife is coming to you as a Muslim lawyer and she
[22:03]wants more than that she wants the full inheritance it is Haram
[22:06]for you as a lawyer to advocate for that I'm stating the
[22:12]law here you're free to do whatever you want I am telling
[22:14]you what the Quran teaches us because this is the law of
[22:20]God in the Quran if they are Muslims they have to respect
[22:22]the law of inheritance in the Quran so this is a common
[22:28]typical scenario or sometimes one thing I find is a father comes
[22:34]and he tells the lawyer I want to deny my son X
[22:39]or my daughter y from The Inheritance why he never was there
[22:48]for me there was tension in the family he disrespected me okay
[22:51]your son your daughter if they're on bad terms with you Allah
[22:55]is going to deal with them but you cannot block block them
[23:01]from inheritance when you die if you own money it has to
[23:04]go to your inheritors even if they were on bad terms with
[23:08]you this is the law of Allah subhana tala this is the
[23:10]law of the Quran if you don't want a child to get
[23:14]any inheritance then while you're still alive and well donate and give
[23:17]all your money to someone gift your money to your wife let
[23:20]her deal with it but if you die and you have assets
[23:24]you cannot block someone from your inheritance another very common example there
[23:29]is an case of divorce so the wife in the court system
[23:34]in the American court system she demands half of the assets of
[23:38]the husband even though this was not stated as a condition in
[23:43]theab in the marriage contract see in the marriage contract you can
[23:47]put whatever condition you want you want 50% you want 80% inshallah
[23:50]you want to put 99% of his wealth is for me if
[23:55]he divorces me that's fine you both agree on that that's your
[23:58]right it's fine but it has to be a condition a in
[24:03]the in the contract if you never put such a condition first
[24:07]of all it's Haram for you to go and demand more than
[24:13]the Dowry yes he can willingly give you you can be smart
[24:16]and talk to him and convince him and soften his heart let
[24:19]him give you half of his wealth that's fine but he has
[24:22]to willingly give it you cannot take him to court and force
[24:25]him this is the law of God brothers and sisters unless you
[24:28]put a condition if you put a condition it's your right so
[24:31]now let's say I'm a lawyer and there's this couple Muslim couple
[24:36]who come to me and the wife says I want you to
[24:40]work on my case I want half of his assets the first
[24:41]question I as a lawyer need to ask did you put a
[24:45]condition is he indebted to you for some reason that you're asking
[24:51]for this amount if none of these apply I as a lawyer
[24:53]I'm not authorized by Allah subhana tala to take that case if
[25:00]I do so I am violating these verses in the Holy Quran
[25:03]and violating the hadiths and I as a Muslim I don't want
[25:08]to do that now does this make life harder for lawyers absolutely
[25:11]does it mean some cases you're not going to take them absolutely
[25:14]but imagine your a when you sacrifice for the sake of Allah
[25:20]subhana tala for the sake of the law of Allah one Hadith
[25:25]beautifully tells us 9/10 of religion 90% of Rel religion it's not
[25:31]Salah it's not fasting and it's not Hajj 90% of religion is
[25:37]in earning a Halal income because it's not easy when you go
[25:47]to the world of business and you're making money there are so
[25:52]many opportunities for Haram many companies are questionable they could be Haram
[25:59]companies companies that support Injustice you deal with Usery and interest directly
[26:04]there are many opportunities for Haram making sure that you live a
[26:10]lifetime of Halal R and income is one of your biggest Jihad
[26:15]it's one of your biggest struggles to say no to Haram money
[26:18]it's not easy but imagine the reward that you're getting when you
[26:24]do that the Hadith States the one who goes and earns a
[26:27]Halal income and he suffers and he works hard to put Hal
[26:32]food to the table is like the one who fights with in
[26:36]the battlefield you get the a of a Shahed you get the
[26:43]a of a Shah if you work and bring halal food to
[26:47]the table and if you especially the mother she's the glue in
[26:50]the house and she is making the marriage successful she is creating
[26:57]a positive atmosphere in the the house with the husband with the
[27:02]children she also receives the reward of a martyr this is the
[27:06]Hadith of the Prophet sallu alai a lady a very influential lady
[27:14]and well spoken lady in Medina her name was as one day
[27:17]she went she stormed into the Masjid and she spoke to the
[27:22]prophet sallallahu alai basically she had an objection Yol Allah this is
[27:26]not fair you men you get to go to war and you
[27:30]become Martyrs you get to go to Hajj at that time it
[27:32]was very difficult for women to go to Hajj so men would
[27:36]usually have the opportunity to go the Caravans the ways there are
[27:39]looters in the way thieves attacking the Caravans it wasn't really safe
[27:43]for some women to go to Hajj alhamdulillah after Islam after a
[27:47]while that changed but for a while it was unsafe so the
[27:49]lady is complaining you go to Hajj and you receive the AER
[27:54]you go to the battlefield and you receive the a then what's
[27:55]in it for us we poor ladies were in the in the
[27:59]home protecting your wealth protecting your family we're being trustworthy in our
[28:03]marriages the prophet was impressed by her intellect the prophet told his
[28:08]companions do you see her level of intellect she very bright lady
[28:15]and she's very well spoken the prophet told her oh Asma what
[28:18]you described right now you stay in the house you're faithful you
[28:22]take care of the children while the men are out there doing
[28:27]the Hajj or in the battlefield you working hard for your marriage
[28:31]for your family you get the Eder all the Eder of those
[28:37]who die as Martyrs in the battlefield you get that aeder she
[28:41]was so happy she almost hollered she left and she told the
[28:47]woman with her I am now the happiest woman on earth after
[28:49]hearing this from so it's not easy to earn a Halal income
[28:55]it's very difficult but that's where you show your faith so I'm
[29:02]very honest and Frank with you my dear brothers and sisters if
[29:05]any lawyer anyone who works in the legal system and you have
[29:08]Muslim clients you need to make sure you're not violating Islamic law
[29:14]if you see a violation which by the way by the way
[29:16]means you have to be educated on Islamic law too if I
[29:20]don't know my Quran and my Islamic laws I won't know what
[29:23]boundaries to cross and not to cross but once you see a
[29:28]violation you can not take up that case now am I saying
[29:31]we cannot have Muslim lawyers absolutely not we need Muslim lawyers we
[29:35]need lawyers who understand our law who understand the law of the
[29:39]land and who can be instrumental in our communities especially in protecting
[29:43]the rights of citizens and Muslims specifically that's something that we need
[29:48]in every Community but we need to know the boundaries so these
[29:52]are the boundaries make sure that if you have Muslim clients you're
[29:55]not violating the law of Allah subhanahu wa ta'ala the second case
[30:02]the the the the third type of clients are between a Muslim
[30:06]and a non-muslim let's say you're a lawyer and there's a Muslim
[30:12]and a non-muslim client what do you do here as a lawyer
[30:16]you look at the law of the land if the law of
[30:23]the land is not against what the Muslim client client is going
[30:28]to receive from this settlement or dispute or court case you can
[30:33]take it because the non-muslim client accepts that law and he believes
[30:38]that law that law is in his religion or it's in his
[30:40]civil beliefs so if a Muslim is receiving something from this dispute
[30:47]and the law of the land recognizes it you can advocate for
[30:55]the Muslim client that's fine the non-muslim client if what he's getting
[30:59]from this case is in accordance with the law of the Quran
[31:02]you can work on that case but if what the non-muslim client
[31:08]is getting defies the law of the Quran and the other side
[31:11]is a Muslim you cannot take that case excuse yourself from that
[31:15]case you're not forced to work on every case that comes on
[31:18]your desk brothers and sisters you have to use discretion and see
[31:21]what crosses the boundary and what does not cross the boundary I
[31:26]know it's very difficult believe me sometimes if there's a lot of
[31:32]money involved it's very very difficult you know they say once a
[31:35]man went to a lawyer and he asked him so what's your
[31:37]rate he told him I charge $250 for three questions he told
[31:45]him three questions come on isn't that too much he told him
[31:48]yal we're done with two what's your third question here sometimes it's
[31:54]very difficult to resist but you have to see is this compatible
[31:57]with the law of Allah subhana wa tala many times when companies
[32:00]or groups are being sued right that's not compatible with Islamic law
[32:07]a neighbor goes sues his neighbor and he gets a million dollars
[32:09]out of them if one of them is Muslim you have to
[32:13]see what the law of God is just because I'm getting a
[32:15]commission of 30% from this lawsuit does not legitimize me working on
[32:20]that lawsuit if that lawsuit is unjust in the laws of Allah
[32:25]subhah wa ta'ala so this is the third scenario that we have
[32:29]now we spoke about lawyers let's now come to you you seeking
[32:36]the services of a lawyer what's the Islamic perspective on that now
[32:40]Scholars have diverse opinions some Scholars a bit on the stricter side
[32:45]they tell you look at theith of who asked IM can I
[32:51]go to their judges to their court system the Imam says you
[32:54]cannot even if it's your h you're claiming you're right you cannot
[33:03]what do the mar today say about this Hadith the scholars many
[33:07]of them understand that Imad he issued this ruling not for any
[33:15]country or Society this was specific to the IDS this was at
[33:20]the end of the omad rule and we know Benya were very
[33:24]oppressive they're the ones who killed Imam Hussein Alam they killed people
[33:28]they stole people's property they were a very unjust Dynasty so IM
[33:33]was telling his companions don't go to their court system because these
[33:38]are corrupt judges and if you go to their system you're strengthening
[33:41]their power and their system and that is going to the to
[33:47]the unjust system so many scholars believe this only applied in that
[33:52]era because of Bena it does not apply let's say to our
[33:54]modern Societies in many parts of the world so so that that
[33:59]is one very common scholarly opinion but here's what the scholars State
[34:02]my dear brothers and sisters and I want you to take these
[34:04]words to heart if there's a dispute between you and a fellow
[34:11]Muslim about anything a business dispute a divorce dispute family dispute you
[34:18]name it the first step that you need to take is to
[34:21]settle it peacefully together according to the law of Allah tell your
[34:25]brother I know we have a dispute let's settle it let's see
[34:29]what Islam says about this I'll give you your right you give

[34:37]not to pick up the phone and call a lawyer the first
[34:40]step is to settle it peacefully with each other imagine if this
[34:47]doesn't work the other guy is stubborn he is taking your h
[34:50]no I'm not going to give you your right or he doesn't
[34:55]even recognize that it's your right in that case Scholars have said
[34:59]yes you can go to your court system a legal system only
[35:02]to claim your right not more than the not more than your
[35:08]right so determine what your right is According to Islamic law and
[35:11]then when you go to court ask for that right only even
[35:15]if the law of the land is going to give you more
[35:17]reject that don't accept more settle for only what Islam allows you
[35:23]to take away in a dispute so it is okay for you
[35:28]to consult a lawyer to go go to a judge to a
[35:31]to go to a court system as long as you are not
[35:36]violating the Islamic law and it's the only way for you to
[35:42]get your right this is if the other person is a Muslim
[35:44]but if the other person in the dispute is not a Muslim
[35:49]and you want to take your ha yes you can go to
[35:53]court and whatever the law gives you even if it's more than
[35:56]the Islamic right because the non-muslims side accepts the law and they
[36:00]believe in that law then it's fine you can get your right
[36:05]that would be okay so this is how we navigate it my
[36:07]dear brothers and sisters to summarize this very sensitive discussion it is
[36:12]okay to be a lawyer and it is okay to seek the
[36:16]services of a lawyer but if the other side is also a
[36:20]Muslim you need to see what does Islam say about these disputes
[36:23]honor the law of God and if there is no peaceful settlement
[36:29]then you can go to the court system and get your H
[36:30]and get your right sisters if your husband is that's your right
[36:35]you talk to him and doesn't work family members talk to him
[36:37]it doesn't work sometimes the scholar of the community talks to him
[36:40]he's he's either stingy or stubborn or angry if he's not giving
[36:44]you your H and the DI you can take him to court
[36:48]that's your right that's the only way for you to salvage your
[36:50]H but if it's more then you're right let's remember these four
[36:56]verses in the Holy Quran my dear brothers and sisters at the
[36:59]end of the day we want to honor the law of Allah
[37:03]subhanahu wa ta'ala and I invite everyone my dear brothers and sisters
[37:07]to educate ourselves about the laws of God now in no way
[37:12]in no way am I sitting here and telling you do not
[37:14]follow the law of the land be good citizens don't do anything
[37:20]illegal by the way what I just said here is not illegal
[37:22]you as a lawyer if there is a case that you don't
[37:27]want to take because it conflicts with your religious values that's perfectly
[37:30]legal you're not forced to take every single case you can use
[37:33]your own discretion to take which case and take and not take
[37:38]certain cases so everything that I have said here is within the
[37:41]law I'm not asking anyone here to violate the law of the
[37:45]land but sometimes you have a legal way of demanding more than
[37:51]the than your Islamic right well you don't have to demand more
[37:54]if the other side is a Muslim demand what's fair in the
[38:00]law of Allah subhanahu wa taala up to that much you can
[38:02]demand it legally but anything more than that would be a violation
[38:07]of our religious principles so I invite everyone to know the law
[38:10]of the land number one know what's legal what's not legal don't
[38:14]do something illegal number two know the Islamic law be educated in
[38:19]Islamic laws it's a shame that I live an entire lifetime and
[38:23]I don't know my laws we only live once my dear brothers
[38:28]and sisters only once and Allah has the greatest right over me
[38:31]when you put rules in your house don't you expect your family
[38:37]to follow those rules when the city issues city codes doesn't the
[38:41]city expect you as a good citizen to follow that well who's
[38:46]more important your family your city or Allah subhana tala the one
[38:49]who created you the least that we can do is to respect
[38:53]the laws of Allah subhanahu wa ta'ala because at the end of
[38:55]the day when we die when we leave this Dunya when we
[38:57]are in our Graves I'm not be going to I'm not going
[39:00]to be answerable not to the president not to the governor not
[39:05]to the mayor not to anyone else you're going to be answerable
[39:08]only and only to Allah subhah wa ta'ala so it's important that
[39:15]I live my life in accordance with the laws that Allah subhana
[39:18]wa taala has given me so I invite everyone to be educated
[39:22]on that and we have a very beautiful Hadith that I'll conclude
[39:26]with a very beautiful Hadith that states when will return will appear
[39:34]education and the intellect will be so widespread in society such that
[39:41]a woman will be an expert on the Quran and she will
[39:46]implement the Quran and the law of God in her house she's
[39:51]going to be implementing the law of God in her house Brothers
[39:54]get ready when the Imam reappears the ladies are going to rule
[39:57]your homes so you better treat them good now so they don't
[40:01]seek revenge when the Imam reappears but it's a beautiful Hadith that
[40:04]shows you the level of education and remember the Imam said this
[40:08]in a time when women did not have access to education when
[40:14]women were marginalized by Society the IM was telling them that when
[40:20]the IM reappears everyone will be so educated so inspired by the
[40:25]laws of the Quran such that a woman will be a scholar
[40:29]she will be an expert on the law of Allah and she
[40:30]will implement it in her own house we ask Allah subhana wa
[40:36]tala to hasten the reappearance of our beloved IM IM I ask
[40:42]Allah subhana tala to bless us in these re remaining days of
[40:47]the month of Ramadan we ask Allah subhana wa ta'ala to forgive
