[0:11]brothers and sisters and welcome to our fourth session of our class
[0:19]islamic family law during the last three sessions we spoke about the
[0:26]different mahrams the three categories and we explained who the mahrams are
[0:30]the mahram's through blood relationships maharam through marriage and maharam through suckling
[0:37]breastfeeding now that we understand who your mahram is we will go
[0:42]on and continue to the next topic and that is the laws
[0:47]of hijab the laws of hijab from whom a believing sister a
[0:53]believing woman must she cover her body from now this we understood
[0:59]in the last topic you don't have to cover which we called
[1:02]ajnabi she must cover so now we'll speak about which body parts
[1:10]exactly does a believer does a woman have to cover which body
[1:14]parts must be covered which we call hijab the laws of hijab
[1:19]now as you remember brothers and sisters we divided everyone into two
[1:26]every man in relation to a woman falls under one of three
[1:33]one of two categories either he is maharan or he is so
[1:37]when we speak about the laws of sight the laws of hijab
[1:44]which areas does a woman have to cover we have to begin
[1:47]by speaking about the ajnabi so if a sister is around an
[1:57]ajnb thank you if a muslim woman is around ajnabi non-related which
[2:02]body part she has to cover and then we'll go to part
[2:06]two maharam which body parts must she cover from a mahram and
[2:12]number three the male believer the muslim brother which body parts must
[2:18]he cover from sisters we will begin with the laws of hijab
[2:24]so which individuals we considered as ajnabi anyone that is not included
[2:29]in the three examples that we mentioned blood relationships through marriage and
[2:35]through breastfeeding becomes an ajnabi so which body parts does a muslim
[2:40]woman have to cover so when it comes to the ajnabi she
[2:45]has to cover the entire body except the face and the hands
[2:53]up to the wrist everything else besides the hand the the face
[2:57]and the face does not include the ears the ears must be
[3:02]covered because you see some sisters they wear a form of hijab
[3:04]or the ears are exposed no the face and the way that
[3:10]i am moving my fingers excluding the neck excluding the ears and
[3:15]excluding the hairline from from the hairline to the bottom of the
[3:19]chin and from right after the ear to the other correspond corresponding
[3:24]part in the face and the two hands up to the wrists
[3:29]anything beside that must be covered by muslim woman now what is
[3:37]the basis of this where does this argument come from from the
[3:41]quran you see there are certain individuals that claim hijab in the
[3:45]way that we're speaking about that muslim women have to cover their
[3:47]body is not mentioned in the quran this is absolutely incorrect there
[3:51]are a few verses in the quran that speak about hijab what
[3:55]are those verses verse number one you can see in front of
[4:01]you he gives some certain commandments and orders to believing men and
[4:11]to believing woman when he comes to the believing woman he says
[4:21]says a few things until he says this is and let them
[4:30]not show their zina let believing woman not show their xena except
[4:35]the apparent zina zina means beauty so the quran is basically saying
[4:41]that woman cannot show their beauty except their apparent beauty they're not
[4:47]allowed to show their beauty except their apparent beauty now what does
[4:52]the quran mean by beauty there's so many tafasir so many explanations
[4:56]from scholars but when we come to the school of thought of
[4:58]ahlurbait we go back to the imams themselves they give us the
[5:04]understanding and the explanation of this verse they tell us that allah
[5:08]subhanahu wa ta'ala and this verse is considering the entire body of
[5:13]the woman as beauty and then he says they have to cover
[5:17]their beauty meaning their entire body except except the apparent beauty so
[5:24]what is the apparent beauty based on this verse there is an
[5:27]apparent beauty and there is a non-apparent beauty right so what is
[5:33]the apparent beauty the verse itself doesn't make it clear the quran
[5:36]has certain verses that the quran itself says there are some clear
[5:48]decisive verses in the quran and there are some allegorical ambiguous verses
[5:51]in the quran when it comes to the ambiguous and allegorical verses
[5:56]how do we understand the true meaning we have to go back
[6:01]to rasulullah they have the authority to do tafsir of the quran
[6:05]so this verse by itself is not very clear let women cover
[6:11]their beauty except their apparent beauty it's not very clear when we
[6:16]go back to the hadith of bait they tell us that the
[6:19]entire body is beauty that has to be covered the apparent beauty
[6:25]that doesn't have to be covered is the face and the hands
[6:29]as i mentioned where's that mentioned and the hadith you see in
[6:31]front of you about this verse where the quran said let them
[6:42]not show their zena they can't show their zina he asked are
[6:47]the arms from the zena the imam said yes that means the
[6:54]arms has to be covered the imam gave him a general law
[7:02]what is zena and what is not zina meaning the appearance you
[7:05]know that doesn't have to be covered the imam said is basically
[7:09]the veil the hijab that we put on on the head the
[7:14]head covering so besides the face is zina and anything that is
[7:19]under or after the rest is zina so exclude the face so
[7:25]the whatever is after it right this is considered as xena and
[7:28]whatever is after the wrist is considered as xena so this shows
[7:33]the entire body zena the only two places that the imam made
[7:37]an exception is the the hand up to the wrist and the
[7:40]face so based on this verse we understand that the entire body
[7:47]must be covered except the face and the hands now this is
[7:50]the first part of the verse that we understand and then there
[7:55]is a continuation in the verse and then allah says so the
[8:03]quran says let the believing woman take their khimar which we said
[8:09]is the head covering and let them cover their jube with it
[8:15]jib in the arabic language means what means the chest the bosom
[8:21]exactly this upper part of the chest is called the bosom so
[8:25]the quran says take your head covering o believing woman and cover
[8:29]your chest with it now i've seen certain individuals they're not scholars
[8:33]they have a blog on the internet they claim to be scholars
[8:36]and they say the quran doesn't say that they have to cover
[8:39]their hair for females it says they have to cover their chest
[8:43]and they bring this as proof how do we reply to this
[8:47]because this is not right this argument is not right but how
[8:51]do we reply to it we replied to it by saying that
[8:56]the quran used the word khimab they have to take their khimar
[9:01]and cover their chest with it so use it as a khimar
[9:05]cover your head and also cover your chest if the quran wanted
[9:09]to say only cover your chest why does the quran say use
[9:13]a head covering to cover your chest use a piece of fab
[9:17]fabric to cover your chest why does the quran say you use
[9:19]a head covering to cover your chest when you don't have to
[9:23]cover your head you use the word khimar that means you're already
[9:26]using it as akimar you're covering the hair you're not covering the
[9:30]neck you're exposing it the quran says cover the neck or the
[9:33]chest also in addition is that clear is that it doesn't make
[9:37]sense to say that the quran is just speaking about covering the
[9:40]chest when he used the word for example i tell i tell
[9:45]someone use your shirt to cover your hands and then he comes
[9:49]he's covering his hands with gloves and he's exposing his chest he
[9:52]says you never said cover your chest you said your hands i
[9:56]told you shirt sure it means cover it covers your entire chest
[9:58]right so the quran says use your khimar to cover the chest
[10:02]that means you're already using it to cover the head because the
[10:05]word means head covering so the quran is saying in addition to
[10:11]covering your head cover the chest now as the sister said why
[10:15]is the quran speaking in this way why didn't the quran just
[10:18]say cover the head and cover the chest this goes back to
[10:21]the custom of the arabs the arabs used to already wear a
[10:25]form of head covering but it looked like a bandana if you've
[10:28]seen a bandana it covers the hair and the head but it
[10:32]does not cover the chest so the quran says good you're already
[10:35]covering the hair use that you're covering the hair with to also
[10:40]cover the neck and that's why it shows us that in order
[10:43]to correctly understand the quran to do tafsir quran we have to
[10:49]understand the context of the verse why allah revealed it upon whom
[10:52]he revealed that what was the custom of the arabs only then
[10:54]we can understand the quran in the right way so now let's
[10:57]go to the second verse the second verse in chapter 33 i
[11:02]believe allah verse 59 allah subhanahu wa ta'ala says this allah says
[11:26]and all the believing women to cast down their jalabib jalabib is
[11:32]the plural form of jilbab jinbab when we go back to the
[11:37]dictionaries they tell us that it was a a over garment that
[11:43]woman used to wear so in today's terms it means abbaya the
[11:47]quran uses the word but in the original arabic word of abbaya
[11:54]so allah is ordering rasulullah to tell the believing woman to bring
[11:57]down their jilbab their abaya over their body now there's a few
[12:02]points i have to clarify regarding this verse number one there's some
[12:05]individuals i've seen they claim that the hijab was only wajab upon
[12:09]the wives of rasulullah this clear this verse clearly negates it because
[12:13]it says tell your wives your daughters and all the believing women
[12:16]number two there are some individuals that claim hijab is mustahab this
[12:20]verse also negates that because remember there's a command is a command
[12:26]it's not something extra no it's not something recommended it's something wajib
[12:30]and finally does this verse mean that women have to wear abbaya
[12:34]i mean abbaya is part of the hijab scholars mention no what
[12:39]we understand from this verse is it necessarily that women have to
[12:43]wear the abaya what this verse means by jilbab is that the
[12:47]clothing that they wear has to be loose you see what's the
[12:50]point of the abaya abaya wasn't brought down from the heaven there's
[12:54]nothing nothing special about it what makes it special is this is
[12:57]that it is loose you cannot see the shape of the woman's
[13:02]body so when the quran uses jilbab this is what scholars say
[13:06]this is what the mufasa say the quran is trying to say
[13:09]let them wear clothing which is loose that does not reveal the
[13:13]body of the lady because remember the first verse we spoke about
[13:17]it just says you have to cover your entire body except the
[13:20]hands and the face but you can wear the tightest of clothing
[13:23]and you could still be following the verse the quran is saying
[13:27]i have to cover the entire body except the hands i'm covering
[13:31]it right this second verse comes and says in addition to covering
[13:34]let it be jilba meaning let it be loose clothing and that's
[13:37]why the second condition to hijab is that has to be loose
[13:42]unfortunately some sisters she's covering the entire body but she's wearing very
[13:46]tight jeans for example very tight clothing this is unacceptable according to
[13:51]the quran so these two verses they make it clear that hijab
[13:55]is wajib that believing sisters believing women have to cover the entire
[13:59]body they cannot show their zina meaning their body except the apparent
[14:05]and as imam sadaq said the apparent part of the body is
[14:09]the hand and the face everything else must be covered and then
[14:12]the second verse shows us that it has to be loose clothing
[14:15]when it comes to prayer only the first condition you have to
[14:20]meet that you have to cover the body but when it comes
[14:25]to uh the matters of hijab because remember it's about modesty it's
[14:28]immodest for a sister to cover her body but at the same
[14:31]time it's very tight what's the point the point of hijab is
[14:34]so that it doesn't attract the eyes so if she's wearing very
[14:38]tight jeans and you see that unfortunately in the communities what's the
[14:42]point of this job what's the point i mean sometimes you do
[14:45]something just because you have to sometimes there's a philosophy behind it
[14:49]the point of hijab is so that men don't look they're not
[14:53]attracted so they don't you know come and and you know it's
[14:57]like you're inviting them with your clothing so when the clothing is
[15:00]tight then that defeats the purpose but you have to make the
[15:05]judgment you see the quran the hadith many times they say general
[15:07]they give general laws you have to make the judgment based on
[15:12]the earth understand so when you say wear loose clothing what do
[15:16]people understand anything that doesn't attract that's why many scholars also say
[15:20]the clothing the hijab that a woman wears should not be something
[15:24]that is the color is very attractive some some ladies they wear
[15:29]the hijab but the colors you know you just want to look
[15:31]and they're wearing crystals and all these things that make it even
[15:37]more attractive than probably not wearing any of that so the point
[15:40]of hijab remember you have to be the judge is that it
[15:45]does not attract does not bring draw attention of males that's right
[15:52]so it goes back to culture it goes back to culture to
[15:56]al or if in my earth meaning in my city wearing colors
[15:58]does not consider it as attracting the opposite gender that's fine but
[16:03]maybe in some more conservative some more conservative societies no anything besides
[16:10]black oh she's trying to deliver you know deliver a message she's
[16:13]trying to send a message he's trying to bring attention so of
[16:17]course it depends on the earth because the point of hijab is
[16:19]modesty of course so as long as loose clothing as long as
[16:22]the entire body excluding the the face and the hands are covered
[16:27]you have to be the judge whether this attracts or not and
[16:29]that can differ from place to place unfortunately one concept that i've
[16:33]been seeing in the past few years the concept of fashion hijab
[16:37]how to make your hijab look good this is completely counter-intuitive i
[16:42]mean this is going against the idea of hijab fashion hijab means
[16:47]i look good i draw attention the hijab means no draw attention
[16:52]so if the point of your hijab is to make you look
[16:58]good that's the exact opposite point of hijab so that's why we
[17:02]have to be careful of fashion hijab yes but there is a
[17:26]difference between that and the fashion hijab that we're seeing just go
[17:29]google fashion hijab and you'll see the new styles and things exactly
[17:33]so you can tell that the point of of these fashion hijabs
[17:39]is to attract attention oh i have the latest fashion and style
[17:43]of the hijab why are you doing that you want people to
[17:46]see would you wear your this hijab if there was no one
[17:50]looking at you obviously not so you have to be the judge
[17:51]remember i say again and again and again the human being allah
[17:55]has given himself the power and the ability to judge himself quran
[18:00]says even though i justify i give excuses but i know deep
[18:14]down this is not a valid excuse so i have to be
[18:16]the judge my personal opinion is that most of this fashion hijab
[18:19]is unacceptable yes if it's just to be needs of course you
[18:22]don't want to come out and look terrible that's fine but that's
[18:26]not what they mean by fashion hijab and as if you just
[18:30]look you'll see what i mean so now that we understand this
[18:33]first law that when it comes to an ajnabi a sister a
[18:38]believing woman has to cover the entire body except the hands and
[18:41]the face and it has to be loose clothing let's go to
[18:46]the next slide there are some exceptions to the law of hijab
[18:50]and i'll mention for you three exceptions the first exception is this
[18:58]number one when a woman when a man wants to marry a
[19:00]woman he is allowed to see that potential life of his potential
[19:10]without hijab now the hadith tell us he can see her without
[19:13]he can see her mahasan this is exactly what the hadith says
[19:17]he can see her mahasan now what is mahasin mahasan according to
[19:24]the arabic language according to scholars mahasan is what is the hair
[19:30]and the neck so basically the head covering she can remove the
[19:33]head covering he can take a look and then he can decide
[19:38]you know what i want to marry you know what i don't
[19:40]want to marry now what is the basis of this the basis
[19:43]of this is the hadith many a hadith but i'll mention one
[19:51]of them meaning the hair and the neck of a woman that
[20:06]he wants to marry said yes now scholars say that you if
[20:14]in order for it to be halal you truly have to consider
[20:18]marrying her some people let me just see 50 girls without hijab
[20:23]and then i'll choose no no no if you've narrowed down the
[20:27]list it's either fatima or zainab let's say but i don't know
[20:31]about the looks maybe the looks is going to be the tipping
[20:33]the tipping you know it's going to tip the scale then you
[20:37]can look you can't just go out and look and if you
[20:39]like someone you'll marry her no no no it has to be
[20:43]a serious consideration that i'm really looking into marrying this girl but
[20:46]i want to see her without hijab i want to look at
[20:51]her real looks can i do that you're allowed to do it
[20:53]so we can't play games with this you know what would then
[20:55]i use this as an excuse to just go and see 20
[20:58]30 woman no no no narrow down the list and then you
[21:02]can do it yes no no it's not a islamically legally it's
[21:09]not a condition but probably i would say morally ethically it would
[21:14]probably be a condition that not necessarily her dad her mom anyone
[21:19]yeah her parents someone her uncle her grandfather whoever and and probably
[21:25]the less time he spends the better it doesn't have to be
[21:28]physically it could be a picture that he sees that could also
[21:32]work a picture could also work um that's that's okay as long
[21:37]as it's just the hair and the neck nothing beyond that so
[21:42]this is the first exception to the laws of hijab exception number
[21:49]two the second exception is old woman old woman that will no
[21:57]longer get married but why will they no longer get married due
[22:02]to their old age for example this old lady is a widow
[22:06]this old lady is divorced or even if she is married but
[22:13]she's at an age where nobody's going to marry her anymore she
[22:17]doesn't even think about marriage so for example 50 years old no
[22:21]that's still there's still prospects of marriage even though it's less than
[22:24]an average woman younger woman but there is 60 years of age
[22:30]in our communities now never no it should be older should be
[22:34]older so i would say probably like senior citizen at least 65
[22:38]70.
[22:39]when a lady is an old lady you know she would never
[22:43]think about marriage nobody even would think that she's going to get
[22:48]married when she reaches that age she can show her hair and
[22:52]she can show even her arms so she has to wear hijab
[22:57]but the hijab could be kind of let's say messy the hair
[23:00]is showing maybe even the neck is showing the arms are showing
[23:04]that's fine where does this ruling come from the quran the quran
[23:09]says this where verse in front of you meaning the old ladies
[23:17]that don't want to get married that don't hope to get married
[23:19]they know they'll never get married they may put off their clothes
[23:31]without showing their ornaments that means they can't wear jewelry and makeup
[23:33]and so on so forth so they can show parts of their
[23:37]body the hadith tell us not the entire body of course meaning
[23:39]the hair the neck and the arms and this is acceptable now
[23:43]is it a good thing no it's much better to wear the
[23:45]full hijab but however if it's difficult for them that's fine if
[23:50]a part of their hair is showing you know they can wear
[23:53]just a veil with that doesn't conceal the entire parts of the
[23:57]hair that's fine some parts of the arm are showing that's fine
[24:01]that's acceptable this is exception number two exception number three medical purposes
[24:08]if there is a necessity now before i mention this there are
[24:14]many individuals listen carefully that believe that a doctor is a maharam
[24:20]remember we said the three mahram's number one blood relationship your father
[24:24]brother number two your husband your father number three the family through
[24:30]suckling and breastfeeding some individuals and i think this is most people
[24:34]they have a fourth category of doctors that's why females as soon
[24:38]as they go to doctors they expose their entire body oh it's
[24:40]a doctor even if you tell them where's your hijab this is
[24:43]a doctor it's as if they're implying so what if he's a
[24:48]doctor a doctor if he's not your brother your father your husband
[24:51]your father-in-law through through suckling he's still an ajnabi remember everyone it's
[24:56]either maharam or his agent a doctor if he does not fall
[25:00]under one of those three the title of being a doctor does
[25:03]not give him authority to see you it does not give me
[25:06]the female authority to expose any part of my body except the
[25:10]face and the hands however only it becomes an exception only if
[25:17]it's a necessity if there is no female doctor to treat me
[25:20]i have to show my hands even my hands my arm i
[25:23]have to show my back my chest my legs anywhere that must
[25:28]be covered if there is no female doctors i can access them
[25:32]only then i may go to male doctors so if there is
[25:38]a female doctor available it is haram brothers and sisters for a
[25:41]muslim woman to go to a male doctor where she is forced
[25:46]to show a part of her of the body that she's not
[25:50]allowed to go to the female there's so many females yes if
[25:52]there wasn't a female then she's on unfortunately most individuals with this
[25:57]law they are very very lenient and careless and reckless even you
[26:01]know religious ladies religious women they think that a doctor is right
[26:07]away go and expose no it should be a last resort when
[26:10]i don't find any other solution fine there's one other one other
[26:14]exception mentioned in the hadith and that is if there is a
[26:18]female doctor but this is for example a surgery and i don't
[26:23]trust that female doctor she's not very very smart she's not very
[26:25]very intelligent not a good doctor the male doctor is much better
[26:30]in this situation fine this is mentioned the hadith but for example
[26:33]i have a cold i have the flu i broke my hands
[26:37]there is no necessity in going to seeing a male doctor in
[26:40]fact if i'm a female there is i don't think it makes
[26:44]sense for me for my primary care doctor to be a male
[26:47]should be a female if there is those necessities you know life
[26:52]and death situations go and see a male and another point brother
[26:57]sister is you know i don't even think i have to mention
[26:59]this but because it's become such a pervasive habit or pervasive phenomenon
[27:08]in societies then you have to mention this that when it comes
[27:11]to you know the ob gyn doctors i s you see some
[27:14]certain muslim woman her ob gyn doctor is a male allahu akbar
[27:18]this is the biggest type of haram when there are females that
[27:22]practice this field of medicine what gives me the right and the
[27:26]authority to go to this man unless it's a life and death
[27:30]yes well i went to the asphalt there was no female i
[27:32]couldn't do anything or the female doctor i i think she's not
[27:36]that good the male doctor fine life in death situation everything becomes
[27:40]halal drinking alcohol becomes if i'm dying and there's nothing to drink
[27:43]besides it we're speaking about normal situations it is ham for a
[27:47]muslim female to go to a male doctor when there's female doctors
[27:52]in the society alhamdulillah here in the u.s you have so many
[27:56]female doctors yes i've seen parts of the middle east where they
[27:59]they have a shortage of female doctors maybe in those situations it
[28:04]would be acceptable but not here in america not in the western
[28:07]countries most of the time you have an abundance of doctors especially
[28:12]obgy and i personally think males should not even go and and
[28:18]you know pursue this career of being an ob gy end doctor
[28:20]unless there was a shortage and you know saving women's lives depended
[28:25]on it which i don't think is true in most societies why
[28:28]would i even pursue that career there's so many careers in medicine
[28:32]i could not pursue except ob gyn so this is something that
[28:37]we have to understand medical necessities as an exception only if it
[28:42]is a true necessity and i'll get to this touching is also
[28:45]haram between people that aren't mahram's but if there is a covering
[28:50]it becomes okay but as but they say as long as you
[28:55]just touch it doesn't require any uh you know pressing or any
[29:01]firm grabbing because this becomes a little inappropriate remember hijab is about
[29:04]modesty so you have to be the judge and this situation i
[29:10]think it would be one of those gray areas i can't say
[29:15]necessarily it's haram because he's not seeing your skin he's not touching
[29:19]your skin but he's pressing and he's also pressing for medical reasons
[29:24]i don't think this would be haram i doubt it but i
[29:29]would say is it better yes it's always better to stay away
[29:33]from those gray areas where it's not so clear i can't say
[29:36]it's haram for sure but it probably would be better to stay
[29:38]away from that you know if if i can see a female
[29:43]doctor much easier much better i can she can touch anything see
[29:45]anything why go and unless unless this doctor is just so much
[29:50]better than all the other female doctors that makes it worth it
[29:53]for me to go to remember we said if it becomes a
[29:56]matter of necessity that's fine but if there uh if there is
[30:01]a female doctor then i will have to answer to allah because
[30:06]remember allah is going to ask you was this dr maharam there
[30:10]was no verse in the quran that said doctor is maharam so
[30:13]you have to have an explanation why you uncovered in front of
[30:16]a male stranger you tell allah because he was a doctor so
[30:19]what where in the quran did i say doctor is okay if
[30:22]it's a matter of necessity life and death okay that's that's fine
[30:26]this is the uncle tells you that's okay but if there's down
[30:29]the road there's a female doctor and you come to the mail
[30:31]what's your justification for that in front of allah you have to
[30:35]have an answer in front of allah allah will answer me he'll
[30:38]try me on the day of judgment he'll answer ask me about
[30:41]every single action that i did so what's the basis of this
[30:46]hukum there's a hadith from abu hamza tamali we have the hamza
[30:50]in ramadan he was also a scholar we just think he was
[30:54]a narrator that memorized the hadith of imam abudhi no he was
[30:58]also a scholar so he says i heard a imam al-baqara or
[31:02]he the imam was asked if a muslim woman has a medical
[31:30]condition in a part of her body that she must cover meaning
[31:32]not the face not the hands in her arms and her shoulder
[31:36]and her chest and her and her legs anywhere in her body
[31:40]and she she needs treatment and what we understand from the the
[31:45]question is that there is a female doctor and there's a male
[31:50]doctor but the abu hamza says but the male doctor arfak he's
[31:53]better he's smarter he's he takes care much better than the woman
[32:00]is she allowed or not to go to the male doctor the
[32:02]imam says yes if there is a necessity then she can do
[32:07]it she can uncover and the doctor can see so this is
[32:12]the basis of this hadith what about a muslim doctor are they
