[0:01]Third Station..
[0:03]Why Do We Give Khums to Marjas We pass this station in
[0:09]10 minutes Iraqis have this saying..
[0:12]They say it out of respect..
[0:14]"You tailor..
[0:15]I wear" It means I agree with every terms you decide and
[0:20]ready to oblige..
[0:21]But sometimes the other party is not fair..
[0:23]and takes advantage..
[0:25]and forces you to oblige..
[0:26]That's why he asks you in this station..
[0:29]'Give me a single hadeeth from imams saying we have to pay
[0:33]khums to marja..' Ok..
[0:35]Let's stop the train and answer this challenge..
[0:38]This objection means you think hadeeth is needed in every detail..
[0:43]this is your opinion.
[0:46]But reality doesn't follow your opinion..
[0:48]Religion has general rules that suffice you from little details..
[0:52]I give you an example..
[0:53]No one doubts that niyyah in shalat is necessary..
[0:58]we all agree..
[1:00]These rituals doesn't mean anything, without niyyah taqarrub but know this..
[1:06]We do not have even a single hadeeth saying clearly that it
[1:10]is obligatory for you to perform shalat or fast with niyyah taqarrub..
[1:14]listen carefully..
[1:15]not even a single hadeeth.
[1:17]What does that mean?
[1:18]We don't pray or fast?
[1:19]of course not..
[1:20]It means when it is clear from quran and hadeeths that some
[1:24]rituals are wajib and the same source proves that every ritual needs
[1:30]niyyah taqarrub, there's no need for Islam to give you specific hadeeth
[1:35]for niyyah in shalat, niyyah in fasting or niyyah in zakaat.
[1:39]There's a general rule you can apply and that's it.
[1:42]you can check this information in any book about fiqh that you
[1:46]like..
[1:46]Same principle in "The Story of Taqleed" Why do you say taqleed
[1:50]is wajib when you don't have any hadeeth about it?
[1:53]We answered back then..
[1:54]You have your opinion and we're not responsible for your opinion..
[1:59]In reality, what's wajib is not taqleed but reaching to the religious
[2:03]law that Allah wants is the wajib..
[2:05]and whatever bridge that gets us there..
[2:08]we use.
[2:08]If you reach the law through ihtiyat (being cautious), you have to
[2:12]do that, if it's through taqleed, you need to make taqleed..
[2:16]and if it's through ijtihad, you have to do it..
[2:19]and on contrary..
[2:20]taqleed is haram for you if you're mujtahid But if you think
[2:24]there must be a hadeeth on taqleed or I won't do..
[2:28]the heritage of Ahlulbayt is not responsible for your personal opinion.
[2:31]Use the same basis here about giving khums to Fuqaha..
[2:35]or their permission in spending it on those who deserve First..
[2:39]After you take khums out of your wealth, this amount of wealth..
[2:44]is it yours or Allah's?
[2:46]Of course it's Allah's.
[2:48]Second..
[2:49]If it's Allah's, can you whatever you want with it?
[2:53]or it's trusted to you..
[2:55]and where to spend is according to His deputy which the infallible
[2:59]Imam?
[3:00]For sure it is a responsibility of Imams.
[3:02]Third..
[3:03]If the Imam is the master of khums and he has the
[3:06]right to spend it, In the age of Ghaiba, what should we
[3:09]do with this wealth in a way we can be sure we've
[3:13]done our duty?
[3:14]Should we spend it according to our desires or should we make
[3:16]sure it is spent as the owners want?
[3:18]And if you spend it wrongly, you are still responsible because you
[3:24]didn't spend it as the owners want.
[3:28]So it's clear now..
[3:29]we go to marjas not because they own khums, neither hadeeth says
[3:34]give the khums to marjas..
[3:36]it's to make sure it is used according to owners wish and
[3:41]finally fulfilment of our duty.
[3:43]Khums is a religious duty and a subject in fiqh..
[3:47]much like Salat, fasting, marriage..
[3:50]in all of these we refer to faqeeh to know what needs
[3:54]to be done according to sharia..
[3:56]First of all, they are the ones who set the limit of
[4:00]khums for us, so it's not logical to trust him in deciding
[4:04]how much I owe but doubting him in where to spend..
[4:07]Ulamas have been aware of attempts to shuffle the truth..
[4:12]That's why we see them focusing on this fact even in their
[4:16]fatwa books they say repeatedly..
[4:18]khums is Imam's right while faqeeh's duty is to specify where to
[4:22]spend it according to Imam's wish..
[4:24]nothing more.
[4:25]Example..
[4:26]80 years ago, Sayyid Muhsin al Hakeem in his book Minhaj al
[4:32]Saleheen spoke about Imam's share with words that have been repeated in
[4:39]all fatwa book til today "Ruling 73: The half that goes back
[4:45]to Imam (may the utmost peace and blessing be upon him and
[4:49]his ancestors) is referred in the times of ghaiba to his deputy
[4:54]and that is the trusted faqeeh who understands its uses either by
[4:58]giving it to him or asking his permission.
[5:01]Its uses are: what is trusted to be satisfactory to Imam; such
[5:06]as the necessities of the believers.." Let's take quick examples from our
[5:12]time..
[5:13]to explain how a faqeeh identify where to spend..
[5:16]First..
[5:18]17 years ago..
[5:19]a number of merchants from Baghdad sent a letter to Sayyid Sistani
[5:23]"O our Sayyid..
[5:24]the marja of the Ummah Grand Ayatollah Sayyid Ali Al Sistani, May
[5:29]his extended guidance remain.
[5:35]It is not unknown to you that some of Baghdad's neighborhoods and
[5:39]districts like Sadr City, Sab Al Boor area and Tanak City etc..
[5:46]struggle with extreme poverty, intentional neglect and difficult living condition..
[5:52]Thus..
[5:53]We turn to Your Eminence to grant permission to us; several merchant
[5:58]and those who are financially capable, from Baghdad, to contribute what is
[6:03]due from us of khums to secure the needs of the believers
[6:08]in those deprived areas according to the Shariah regulations." "The response In
[6:13]the Name of Allah the Most High, You are authorized to do
[6:16]so.
[6:16]May Allah bless you with all that is good and increase your
[6:21]rewards.
[6:22]Peace be upon you and all our fellow believers, and may Allah's
[6:27]mercy and blessings be upon you." Two years after this message, Sayyid
[6:31]gave a general authorization, written to all Iraqis, not just those in
[6:36]Baghdad, allowing them to spend their khums without transferring even single penny
[6:39]to the office of Sayyid.
[6:41]But let's postpone reading the message to the next station.
[6:45]and just stay with me The second example of how the jurist
[6:49]determines the avenues for spending the Khums..
[6:52]in the past year..
[6:53]the Iranian city of Kermanshah was hit by a devastating earthquake, and
[6:57]many followers of Sayyid al-Sistani in Iran requested his permission to spend
[7:02]their khums on the victims.
[7:04]Sayyid, after examining the situation, decided to permit only half of the
[7:08]share according to his asssesment of the extent of the need.
[7:12]The third example..
[7:14]Years ago, we didn't have anything called volunteers.
[7:18]Then circumstances changed, and incidents occurred that led to The Fatwa and
[7:22]Mujahideen.
[7:23]Over the years, the religious authority managed a logistical epic..
[7:27]through 300 authorized agents, each of whom was present with a group
[7:33]that requested daily permission to spend money on various cases..
[7:37]in this battle, they needed equipment, and that fighter needs a prosthetics..
[7:42]This martyr's family needs expense, and this group needs a bus to
[7:47]join or to return home, and so on.
[7:51]The entity that managed this work and determined each case that needed
[7:55]to be spent on from khums or not..
[7:58]is the knowledgeable jurisprudent who knows what pleases the Imam.
[8:01]Fourth example..
[8:02]In the year 2020, the coronavirus pandemic caused people to stay at
[8:06]home for several months, and many of them were daily wage workers.
[8:10]The difference of a day's worth of income could be crucial for
[8:13]them.
[8:13]The religious authority's assessment of the situation was that spending khums on
[8:16]these cases was necessary, and he issued a decree allowing it, in
[8:20]addition to calling the maukibs to participate in support campaigns The fifth
[8:26]and last example There is a sad wave of Alawite lineage claims,
[8:31]and we see daily a group of people declaring that they are
[8:34]sayyids and wearing the kufiyya or green shemagh based on documents, family
[8:38]trees, or the words of some lineage people.
[8:41]Here, things may seem ambiguous to an ordinary person who may believe
[8:45]any yellowed paper or old-looking family tree and give a share of
[8:50]the khums to these claimants.
[8:52]However, the jurist..
[8:53]knows the shar'i aspect of the matter and can assess a person
[8:57]without any misconception..
[8:58]Does this person deserve a share of the khums or not?
[9:02]The summary of this station is..
[9:04]that your money, O trustee of Allah, is in our hands.
[9:07]How should we spend it?
[9:08]And why should we specifically go to the scholars?
[9:11]Who taught us to return to them and seek their permission?
[9:14]Of course, when Imam Ali says, "Whoever among our Shia becomes a
[9:19]scholar in our Sharia, then he brings our weak Shia out of
[9:24]the darkness of their ignorance to the light of knowledge, which we
[9:27]have bestowed upon them.
[9:29]He will come on the Day of Resurrection with a crown of
[9:32]light on his head." And when Imam al-Sadiq says, "Whoever among you
[9:37]has narrated our Hadith, examined our halal and haram, and knows our
[9:43]rulings, let them agree upon him as a judge." After these words,
[9:46]do not expect us to knock on any door other than that
[9:49]of the jurists.
[9:50]The trust built between the scholars and the people..
[9:52]did not come by chance or naivety.
[9:55]The simplest person gives one-fifth of his wealth.
[9:57]He lives through a thousand-year-old experience..
[10:00]that enables him to identify who the true scholars are, who can
[10:05]be entrusted with lives and souls, not just money..
[10:09]Events of years and the fatwas of jihad..
[10:12]are witnesses in front of you..
[10:15]Thanks for watching!
